License to Use
Y3 Technologies Pte Ltd ("Y3") grants the user a non-exclusive, non-transferable, royalty-free, limited and revocable license to use the EPOD service and product ("EPOD") only for commercial use in accordance with these terms. Any use of the EPOD in any other manner, including without limitation, any modification or distribution of the product or text, graphics, data, hyperlinks, intellectual property and other content associated therewith is not permitted.
User Information
By using the EPOD, the user consents to the collection, transmissions, use and protection of his/her information to Y3. The user shall be responsible for maintaining the confidentiality and security of his/her information transmitted from or stored on his/her computer device for the purposes of the EPOD. Y3 shall not be responsible in any way for any loss (including loss of the user's information) arising from the use of the EPOD.
Acceptable Use
The user agrees not to use EPOD in violation of any laws or regulations applicable from time to time or to misuse the EPOD App in any manner deemed as inappropriate by Y3.
Indemnification
The user agrees to indemnify, defend and hold harmless Y3 and/or its employees and agents from and against all claims, damages (actual and consequential), losses, costs and expenses that is directly or indirectly attributable to the user's breach of these terms, including any use or misuse of the EPOD.
Warranties / Representations / Guarantees
Y3 provides this EPOD on an "as is" basis and the user agrees that he/she is using the EPOD at his/her own risk. To the fullest extent permitted by law, Y3 does not make any warranty, representation or guarantee (whether expressed or implied) that the EPOD and/or its contents is/are of a satisfactory quality, accurate, non-infringing, free of errors and/or able to operate on an uninterrupted basis.
Intellectual Property
The logos, graphics, marks used in connection with the EPOD are trademarks or registered trademarks belonging to either Y3 or other respective owners. These marks may not be copied, imitated or used (in whole or part) without the prior written permission of Y3 or the applicable trademark owner.
Amendment of Terms
Y3 may amend these terms from time to time without prior notice to the user. The user shall be deemed to have agreed to the amended terms by his/her continued use of the EPOD.
Governing Law & Jurisdiction
These terms are governed by the laws of Singapore and the courts of Singapore shall have exclusive jurisdiction for the purposes of any dispute arising out of or in relation to the use of the EPOD and/or these terms.
